Is plagiarism a violation of FERPA?

One of the provisions of the Act is that students records, (including student papers), should not be released to third parties. Thus, instructors using the plagiarism detection service are said to be violating FERPA by releasing student papers to a third party. Companies running plagiarism detection service, on the other hand, claim that their service does not constitute FERPA violation. The Department of Education Family Policy Compliance Office (FPCO) guidelines suggest that if a student submits his paper to a plagiarism detection service himself and receives the originality report, it is not a FERPA violation. The understanding is that since the papers have not been submitted to the teacher, it does not constitute an “education record” according to FERPA. Conversely, if an instructor submits a student paper to a plagiarism detection service, with all the personally identifiable information on the paper having been removed, it does not constitute FERPA violation. This privacy debate is far from over. [18]

How does SafeAssign work?

SafeAssign has been used primarily by teachers as a tool to deter students from plagiarizing. From this standpoint, individual students typically upload their academic papers directly to the SafeAssign service at the request of the teacher. Alternatively, teachers may also submit students' papers to the SafeAssign service if they suspect the act of plagiarism. After students have submitted their papers, the teacher then checks for plagiarism by accessing the originality reports. Students who are found guilty of performing the act of plagiarism may be punished by the teacher. Punishments imposed by teachers and institutions for plagiarism offenses could range from failing a course, suspension, and dismissal [5]. However, studies indicate that the use of plagiarism detection service does not deter students from plagiarizing [6] [7] [8]. For example, research suggests that students who have prior knowledge that their academic papers would be scanned using plagiarism detection software are more likely to plagiarize compared to their counterparts who are not aware of such a measure being used. [7]

Can instructors use SafeAssign?

Instructors can deploy the SafeAssign service in two main two ways. First, an instructor can set up SafeAssignments in his Blackboard courses and require his students to submit their papers to these assignments. All the papers submitted by the students to the SafeAssign server are checked against SafeAssign's comprehensive databases.
